Controversy over Construction on Gasova Street in Lviv

A five-story residential building was constructed on Gasova Street in Lviv without coordination with the Ministry of Culture.

During the court proceedings, the developer had already built the building and sold all the apartments.

According to the case, in 2016, the Lviv City Executive Committee issued conditions and restrictions for the construction of a multi-apartment residential building with commercial premises at 5a Gasova Street. In May 2017, a Ministry of Culture employee inspected the construction site and drew up a survey report on the built-up situation within the historical area of Lviv.

In particular, to start construction work in the historical area, the developer must obtain approval from the Ministry of Culture. However, after the inspection, a Ministry of Culture inspector issued a resolution for the immediate cessation of land and construction work. The developer decided to challenge the ministry’s decision in court.

In 2018, the Lviv District Administrative Court and the Lviv Administrative Court of Appeal granted Myroslav Moroz’s lawsuit, declaring the Ministry of Culture’s decision unlawful and canceling it. However, the Supreme Court later sided with the Ministry of Culture, upholding their decision to halt construction.

Despite the legal battles, the multi-apartment building at 5a Gasova Street in Lviv has already been built, put into operation, and fully occupied. The dispute highlights the importance of proper planning and coordination in construction projects.
